04. REFUND POLICY
We do our best to make every customer pleased with the purchase and we firmly believe in our product, but we understand that we can’t make 100% of you all happy. Due to the nature of digital products, which cannot be returned, we cannot grant a refund if you simply change your mind after purchasing a BestRedmineTheme product or service or if you purchased the theme just for evaluation purposes. In order for us to consider a refund request, we require that you meet the below refund policy conditions fully. If you have an issue that we are unable to resolve that makes the system unusable, we will be happy to consider offering a refund. We may ask you questions pertaining to the nature of your refund request.
Refunds will be offered at our sole discretion and must meet all of the following conditions fully:
- You are within the first 30 days of the original purchase of the plugin.
- Your issue(s) comes from not being able to install the theme properly or get the theme to perform its basic functions.
- You have attempted to resolve your issue(s) with our support team.
- No refunds will be granted after the first 30 days of the original purchase whatsoever.
- Issues caused by 3rd party plugins or other software will not provide grounds for a refund.
- You agree to deactivate and uninstall BestRedmineTheme from your site before a refund is granted.
No refund will be considered for “Do it for Me” plans, when the theme adaptation has already been performed by our team.
By purchasing plugin(s) from our site, you agree to this refund policy and relinquish any rights to subject it to any questions, judgment or legal actions. We are not liable to cover any differences in exchange rates between the time you purchased and the time you are refunded.
05. PRODUCT SUPPORT
BestRedmineTheme’ products and designs are provided “as is”, with no implied warranty that they will function exactly as you wish or with all third party components and plugins. We do, however, offer support via our knowledge base and email.
Support tipically covers help to:
- Change fonts.
- Change colors (main/header, secondary/other elements, trackers, priorities).
- Remove sticky/fixed header.
- Change login background.
- Embed new favicon.
- Use/remove “my page” as the home page.
Support does not cover:
- making structural changes to the theme.
- adapting the theme to offically not supported plugins.
- installation, customization, and/or administration of Redmine itself.
06. PRODUCT UPDATES
Each individual product purchased from BestRedmineTheme includes complimentary updates for 6 months from the date of purchase. If customers continue their annual subscription after the 6 months period has lapsed, they will continue to receive updates up until the subscription expires. BestRedmineTheme does its best to improve each product over time and make sure they will work with the latest version of Redmine. We cannot guarantee that our themes will run with older versions of Redmine (2.5 or earlier).
07. SOFTWARE MODIFICATIONS
Customers are free to make any changes and/or modifications to our products to suit their needs. This includes all CSS and JS files distributed with our products. However, if these changes haven’t been indicated or recommended by our support service, we can’t provide support to theme, due to difficulties troubleshooting and debugging custom changes.
08. CUSTOMER ACCOUNTS
Customers will be required to create an BestRedmineTheme account when purchasing any of our products and/or services. They are responsible for maintaining the confidentiality of their password and are not permitted to share and/or distribute their account login details. Customers are fully responsible for all activities that occur under their account and agree to immediately notify BestRedmineTheme of any unauthorized use of their account or any other breach of security. BestRedmineTheme will not be liable for any loss or damage arising from customer failure to comply with these terms. Please note that BestRedmineTheme requires that all users be over the age of 13 to have a customer account.
09. EMAILS
BestRedmineTheme may occasionally send you emails related to the purchase of product(s) from our company. We may also send you occasional email newsletters relating to BestRedmineThemes updates, promotions and the like. We will never sell or release your email to any third party vendors. You may opt out of these emails at any time without penalty.
10. ACCOUNT TERMINATION AND SUSPENSION
BestRedmineTheme reserves the right to suspend and/or terminate any user account without notice, in its sole and absolute discretion. No refunds will be provided to customers who have their accounts terminated. Examples of reasons for termination include:
1) Abusive behavior and/or excessive negativity towards the BestRedmineTheme staff and/or other BestRedmineTheme customers;
2) Repeated defamatory, malicious, and/or false statements including slander against BestRedmineTheme, and/or attempts to persuade potential customers away from purchasing BestRedmineTheme products;
3) Promoting competitor products, contributing to software piracy, hacking, spamming, or other illegal acts;
4) BestRedmineTheme reasonably believes that your account has been compromised, shared with others, or for other security reasons.
11. SOFTWARE OWNERSHIP
Customers may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of BestRedmineTheme.
12. PRODUCT DELIVERY
After we have successfully received customer payment, their BestRedmineTheme customer account login information will be emailed to the email address provided during signup. This usually happens within 1-2 minutes.
13. PRICE/PRODUCT CHANGES
BestRedmineTheme reserves the right at any time to modify and/or discontinue a product with or without notice. Further, we may add new products and/or services with or without notice. Prices of any products are subject to change at any time by posting the changes to the BestRedmineTheme website.
14. BUSINESS USE OF OUR GOODS AND SERVICES
If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify BestRedmineTheme and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Good or Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.
15. PRODUCT WARRANTY
BestRedmineTheme guarantees that our products will provide commercially reasonable functionality with Redmine 2.5+, without any Redmine plugins installed and the officially supported ones, which will be announced on our website. Other than this, BestRedmineTheme does not provide any warranty.
Other than as expressly set out in these terms or additional terms, neither BestRedmineTheme nor its suppliers or distributors make any specific promises about its goods or services. for example, BestRedmineTheme doesn’t make any commitments about the content within the goods or services, the specific function of the goods or services, or their reliability, availability, or ability to meet your needs. we provide the goods and services “as is”.
Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by law, we exclude all warranties.
16. LIABILITY FOR OUR PRODUCTS AND SERVICES
When permitted by law, BestRedmineTheme, and BestRedmineTheme’s suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.
To the extent permitted by law, the total liability of BestRedmineTheme, and its suppliers and distributors, for any claim under these terms, including for any implied warranties, is limited to the amount you paid BestRedmineTheme to use BestRedmineTheme’s goods and/or services.
In all cases, BestRedmineTheme, and its suppliers and distributors, will not be liable for any loss or damage that is not reasonably foreseeable.
17. MISCELLANEOUS
Payments. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Updates To TOS. The TOS may be updated from time to time, but never retroactively. We will post notice of modifications to the TOS on this page, and they will become effective no less than fourteen days after they are posted. However, changes addressing new functionality, or to address changes in the law, or for other urgent legal reasons may be made effectively immediately.
Other Guidelines Or Terms. If there is a conflict between this TOS and those for a specific BestRedmineTheme service, the terms for the specific service will prevail.
No Third Party Beneficiaries. These terms control the relationship between BestRedmineTheme and you. They do not create any third party beneficiary rights.
No Waiver. If you do not comply with these terms, and BestRedmineTheme does not take action right away, this doesn’t mean BestRedmineTheme is giving up or waiving any rights, such as the right to take action in the future.
Severability. If a particular term in the TOS is not legally enforceable, it will not affect the other terms.
Applicable Law and Venue. The laws of Spain will apply to any disputes arising out of or relating to these terms or the Services. All claims arising out of or relating to these terms or the Services will be litigated exclusively in the regional courts in Valencia, Spain, and you and BestRedmineTheme consent to personal jurisdiction in those courts.
